Property and Evidence

The Property & Evidence Unit maintains the integrity and security of evidence that is seized at a crime scene by department personnel, found property turned in to locate the owner, relinquished property, and property for safekeeping.

Return of Property

If you have had property seized for safekeeping or as evidence, you were given a property receipt at the time of seizure with instructions on the form back for retrieving your property. Refer to the property receipt number in the top left corner or police report number in the top right corner when communicating about this property or evidence.

All property taken by the Canby Police Department as evidence in a crime or recovered stolen property will be held until either destruction is ordered by the trial court or its release approved by the Clackamas County District Attorney's office. Once this information is received, the owner of the evidence is contacted by the Property/Evidence unit by mail.

After notification, property must be picked up within 30 days or it will be disposed of as provided by law.

NOTE: We will not release property involved in an ownership dispute until rightful ownership is determined. You must present photo identification and one of the following:

1) The property in custody report that lists you as the owner of the property.
2) Possess a notarized statement from the owner of the property granting authority to you to receive their property.

To request release of property, complete a written Property Release form and send to the police department (contact information at the bottom of this page).

To request release of property owned by someone else, complete a written Property Release-Notary form and bring or send to the police department (contact information at the bottom of this page).

Release of Weapons

A background check will be performed to ascertain the eligibility of the claimant to possess the weapon. The required background checks can take up to 30 days and an appointment will be scheduled when these checks are complete.  To request to have a weapon(s) returned per the process above, complete a written Firearms Release Request form.  All firearms will be run through the ATF.  If you are not the original owner, proof of ownership will be required.

Found / Unclaimed Property

Per Oregon State Statute, found unclaimed property is deemed abandoned and will be held for 90 days. After this time, it is either destroyed or sent to auction according to state law.

If you are claiming found property, be prepared to provide a detailed description of the property, the circumstances of its loss and proof of ownership as necessary. Positive identification is required before property will be released.

If not claimed, items may be sold at auction, destroyed, donated, or returned to the finder.

Found Property / Finders Claim Information

Release of Property by Appointment Only

The Evidence Technician processes property and evidence releases by appointment only and identification is required.
